Veterinarian Release

GOOD NIGHT PUPS while I'm away, and they have been permitted to bring my pet(s) to your office for scheduled appointments or in case of an emergency. I give you permission to care for my pet(s), and I agree to pay for it when I get back.

Locksmith Release

Good night pups will be taking care of my pets while I'm away. It is essential that a representative of this company be permitted enter into my house. I give Good Night Pups and or Representatives of Good Night Pups permission to handle any issues with broken keys or locks on my property. In the case that a sitter needs to hire a locksmith to enter a client's property because the client failed to leave a key or the lock or key malfunctioned, the customer is responsible for paying all associated charges. In the event of the aforementioned circumstance(s), the Client expressly grants the pet sitter/company the right to hire a locksmith on the Client's behalf.

Key Release

I hereby confirm that I am giving Good Night Pups (1) sets of keys to the

residence that I have tested. Whenever I submit a request in writing (or by email), over the phone, or in person, Good Night Pups has my permission to enter my house to provide pet care services. I understand and accept that my key will be maintained on a key ring without any information that may be used to identify me specifically. I acknowledge that Good Night Pups will take reasonable precautions to protect my key, and I absolve them of any further liability in this regard.

Terms of Service Agreement

This Agreement is between "Client(s)" and Good Night Pups "Sitter".

Whereas the Owner desires to retain the Sitter's services, and the Sitter consents to provide them under the terms and conditions outlined in this Pet Sitting Contract as well as the Owner's Information sheet, Pet Information sheet(s), and the Veterinary Release Form, all of which shall be deemed to be a part of this Contract.


In this contract, any references to pets must refer to the animals listed on the Pet Information Form(s).


Relationship and Responsibilities It is well known that the Owner hires the Sitter as an independent contractor, not an employee, and that this is how they will work together.


The Sitter is in charge of all insurance costs as well as any required tax filings and payments, including, if necessary, income taxes. The Owner agrees to give all information required to support the Sitter in providing the agreed-upon services in a timely, trustworthy, and loving manner.


Compensation In exchange for their services, the Sitter shall be compensated in full before services are rendered. Payment shall be made in cash or card only. Only paid in full accounts are guaranteed service dates.


The Sitter will get payment in the amount of emergency day fee prices with no reductions allowed for the Owner's early or late departure. In addition, there may be charges for transportation, unforeseen visits, and unanticipated medical costs as well as the purchase of consumables for the pet(s), such as food, litter, or cleaning products.


In order to demonstrate any additional costs, the Sitter must keep and

submit receipts. The Owner agrees to pay the Sitter, within 14 days of the end of the pet-sitting agreement.


Duration This Pet Sitting Contract shall come into effect on the start date and shall terminate on the end date. If asked by the Owner and agreed to by the Sitter, the duration of this Pet Sitting Agreement may be extended.


Prior to or on the last day of this contract period, the Owner shall be responsible for confirming his or her return and availability to resume care of the property and pet(s), failing which the Sitter may undertake further visits in the pet's best interest(s).


Any additional duties or visits will be compensated at the normal daily rate per day or per

visit.

Cancellation or Termination Without incurring fines or damages, either party may end this pet-sitting agreement at least 72 hours before the first planned visit. A 30% cancellation fee of the total amount owed will be assessed if the Owner cancels without providing the minimum notice needed or does so during a recognized holiday, unless the cancellation is due to inclement weather, a death in the family, or an urgent medical situation.


If the Sitter must cancel later than 72 hours before the Owner's departure due to unforeseeable circumstances, the Sitter may name a replacement with the Owner's written consent, and any difference in the fees paid shall be for the Sitter's account. If a pet starts acting aggressively or dangerously, the sitter may: Make arrangements with the pet's guardian to take care of the animal until the owner returns;


If the Guardian is unable or unwilling to take care of the pet, the Owner may, at its expense, place the animal in a kennel or other animal care facility. In either of the above scenarios, this agreement will be assumed to have ended unless the sitter consents to carry on with extra housekeeping tasks and/or pet care for additionally stated pets without a pay cut.


Any inaccurate or deceptive information on the Owner's Information or Pet Information forms could be considered a violation of the provisions of this Pet Sitting Contract and cause it to be immediately terminated. Any reimbursements or relief from unpaid balances are not granted to the Owner in the event of termination under the above-mentioned scenarios.


Either party may cancel or make changes to this Agreement upon 7 days' written notice to the other party. Email is acceptable. Booking/Payment The Owner must pay the Sitter in full to secure their services. The balance shall be paid by cash or card.


Either party may terminate this Agreement immediately upon written notice to the other party in the event of a breach of the terms of this Agreement or for any other reason deemed appropriate by the terminating party.


Liability In relation to the services rendered for the Owner, the Sitter shall be covered by liability insurance. The Owner acknowledges that a copy of the insurance policy has been made available to him or her and that he or she is aware of its terms. If another individual has access to the property during the time of this agreement, The Sitter accepts no responsibility for any security violations, loss of, or damage to the Owner's property.


Any accident of any kind that may befall a pet or that is brought on by a pet that has unsupervised access to the outdoors shall not be the responsibility of the Sitter. In the event that the pet injures the Sitter, the Owner shall be responsible for all medical costs, damages, and loss of use of the Owner's property.


The sitter is relieved from all liability relating to the transportation of the pet(s) to and from any kennel or veterinarian office, as well as the cost of the pet(s)' medical care.

Indemnification The parties agree to release and hold harmless each other from any and all claims resulting from each party's willful or negligent behavior, as well as their respective employees, heirs, and assigns.


Emergencies The Sitter must call the Owner at the numbers provided in the event of an emergency to confirm the Owner's course of action. The Sitter is permitted to do the following if the Owner cannot be reached promptly: Transport the pet(s) to the listed veterinarian; Request on-site treatment from a veterinarian; Transport the pet(s) to an emergency clinic if the previous two options are not feasible.


Security The Sitter promises to maintain all of the Owner's keys, remote control entry devices, access codes, and personal information secure and secret and to return them to the Owner at the conclusion of the contract or right away upon request.


Relaxation for Terms No party's relaxation, indulgence, waiver, or release of any of its rights under the terms of this pet-sitting contract on one occasion will preclude the later enforcement of those rights, and it will not be interpreted as a waiver of any subsequent breach of any of the conditions.


Whole Agreement The Owner's Information Sheet, the Pet Information Sheet(s), and the Veterinary Release Form attached together with this Pet Sitting Contract constitute the entire and only agreement between the parties with respect to the subject matter hereof, and the parties hereby waive any right to rely on any purported expressed or implied provision not contained therein. This Agreement may not be modified except by a written amendment executed by both parties.


Assignment No party may assign any of its rights or delegate or assign any of its obligations under the terms of this pet-sitting agreement without the other party's prior written consent, with the exception of situations where the pet's Guardian may be called upon to provide care for the pet due to bad weather or a genuine emergency (s).


Binding Effect The terms of this Contract shall be binding upon and accrue to the benefit and be enforceable by either party's successors, legal representatives, and assigns.

Emergency In the event of an emergency, the Sitter agrees to contact the Owner immediately. If the Owner cannot be reached, the Sitter shall contact the designated Emergency Contact.


Photography The Owner gives permission for images and videos of their house to be used for promotional purposes on the website, social media, and/or in marketing materials. The Owner is aware that the photos and videos might have been taken in different places and at varied times. In exchange for the use of the photos and videos, the Owner promises not to pursue any financial or other claims against the sitter.


Abandonment The Sitter shall be deemed to have abandoned the home if they are absent from the premises for more than 1 consecutive days without prior notice to the Owner. Medical The Sitter agrees to assume responsibility for any medical care that may be required for themselves during their stay in the home. Holiday If the period of house sitting includes a major holiday, the Sitter agrees to perform any duties reasonably associated with the normal business day.

Maintenance and Repairs The Owner agrees to make payment, either directly to the service provider or as a reimbursement to the Sitter, for the following urgent repairs:

  • burst water service blocked or broken lavatory system

  • serious roof leak

  • gas leak

  • electrical faults

  • flooding or serious flood damage

  • serious storm damage

  • serious fire damage

  • failure or breakdown of the gas, electricity, or water supply to the premises

  • failure or breakdown of any essential service for hot water, cooking, heating, or laundering

  • any fault or damage that causes the premises to be unsafe or not secure


Reimbursement for repairs The Owner agrees to pay the Sitter, within 14 days of the end of the house sitting assignment, any reasonable costs that the house sitter has incurred for making repairs to the premises so long as:


  • the Sitter was not in breach of this agreement when the damage occurred

  • the Sitter gives the Owner, or their nominated contact, a reasonable opportunity to make the repairs

  • the Sitter makes a reasonable attempt to have an appropriate tradesperson named in this agreement make the repairs

  • the repairs are carried out, where appropriate, by licensed or properly qualified persons

  • the Sitter gives the Owner, or their nominated contact person, written details of the repairs, including receipts for any costs the house sitter has incurred

Governing Law Should any provision of this Pet Sitting Contract and Agreement be determined by an appropriate court to be invalid, it shall not in any way affect the remaining provisions. This Pet Sitting Contract and Agreement shall be construed, interpreted, and governed in accordance with the laws of the State of Colorado.


General The parties understand that any or all portions of this agreement may be delivered to the other party in readable and recordable electronic form and that such portions shall be deemed to have been delivered upon the receiving party's acknowledgment of receipt.


The headers of paragraphs are merely there for the convenience of reference and are not meant to affect how rights or obligations under this agreement should be interpreted or determined.


When suitable, terms denoting one gender also denote the other, and vice versa for words denoting single and plural.


The Parties hereby agree to the terms and conditions set forth in this Agreement, and such is demonstrated throughout by their signatures below:
